    For years, the word "governance" in the context of AI meant something abstract — a policy buried in a legal department, a committee that met quarterly, a framework that looked impressive in a board deck but had no operational teeth.

    That era is over.

    In February 2026, AI governance is a live issue in board meetings, a line item in regulatory enforcement priorities, and (increasingly) a factor consumers and business partners are using to decide who to trust.     Governance failures are no longer theoretical. AI-generated content that was never disclosed to consumers. Customer data is fed into AI tools without proper safeguards. Hiring decisions are influenced by algorithms that couldn't be explained or defended.     The bigger risk is what one compliance expert recently called "AI washing", claiming responsible AI practices without the governance infrastructure to back them up. The SEC has flagged this as an area of active focus. The FTC has enforcement authority over deceptive AI claims. State attorneys general are watching.

    Companies that can't demonstrate how they govern AI (not just that they use it) will face regulatory exposure, reputational damage, and a very difficult conversation with their board.

    Governance Is Now a Competitive Signal

    Here's what we find most interesting about this moment: governance is becoming a growth driver, not just a risk mitigation function.

    The World Economic Forum published a piece this month titled "Why Effective AI Governance Is Becoming a Growth Strategy." The thesis is straightforward: organizations that embed governance early avoid the fragmentation, duplication, and operational risk that eventually hobbles AI at scale. More importantly, certified and verifiable governance creates customer confidence that translates into lower acquisition costs, higher conversion rates, and stronger retention.

And in a market where 81% of consumers report they don't trust companies to be honest about AI, verified practices are not a nice-to-have — they're a category differentiator.

    • What AI tools and systems are currently active in your company, in customer-facing marketing, in internal operations, in how your team does its work?

    • How do customers know when AI is involved in their experience with your company?

    • What is your incident response plan when an AI system produces a harmful, inaccurate, or biased outcome?

    • How are you monitoring compliance with current and emerging state and federal AI regulations?

    • What is the impact of your AI adoption on the employees doing the work, and what are you doing to ensure it strengthens rather than degrades their experience?

    These are not hypothetical questions. They are the questions regulators are asking, that informed customers are beginning to ask, and that your competitors are either preparing to answer or hoping won't come up. Governance is the difference between having answers and hoping for the best.
